Relationship of the European Union With State Sovereignty

Sovereignty within the European Union brings many problems to political discourse. In order to solve these conflicts we must define our terms precisely. This essay define the term sovereignty by re-visiting many concepts and various authors and thinkers. Then analysis move on to assess the decision making mechanism within the European Union to determine who is the main sovereign body. Meanwhile the comparison will be made between the European Union and those of the classical supranational institutions or federal states. In this part the author will try to find an answer to the question of whether or not whether the Member States of the European Union lose their state sovereignty when entering to the Union and whether or the European Union challenges classical definitions of state sovereignty. Finally the essay will present external aspect of sovereignty of Member States by using an example of Common Foreign and Security Policy.

Avrupa Birliği ve egemenlik kavramı arasındaki ilişki hukuki ve politik literatürde birçok tartışmaya ve çatışmaya gebedir. Çatışmaların çözümü için kavramlarımızı yerinde ve eksiksiz tanımlamak gerekmektedir. Bu yazılı eser egemenlik kavramını tanımlamak için birçok farklı konseptin ve bu alanda çalışmaları olan düşünür ve yazarların yaptığı çalışmaların analizini yapmıştır. Analiz kendisine çalışma sahası olarak Avrupa Birliği’ndeki karar alma mekanizmalarını mercek altına almış ve kendisine hangi kurumun esas egemen güç olduğu sorusunu dert edinmiştir. Bunun yanısıra, Avrupa Birliği ve diğer milletlerüstü oluşumların ve federal yönetim biçimlerinin karşılaştırmaları yapılmıştır. Bu karşılaştırmanın sonucunda yazar “Avrupa Birliğine üye ülkelerin Avrupa Birliği üyesi olmakla beraber milli egemenliklerini ‘Birliğe’ kaybettiler mi?” Yoksa, “Avrupa Birliği’nin bir yönetim biçimi olarak klasik devlet egemenliği kavramını sarstı mı?” sorularına cevap bulacaktır. Sonuç olarak bu makale Avrupa Birliği’nin Ortak Dışişleri ve Güvenlik Politikasını Masaya yatırarak Birliğe üye ülkelerin dış egemenlik konusundaki durumunu değerlendirecektir.

Chapter 1: Introduction

“There is nothing bad about collecting tax, the problem is who to collect them”1

The European Union is an example of unique form of governance. This unique form brings lots of problems to political discourse as well as many advantages. The most important questions possessed so far are whether the Member States of the European Union lose their state sovereignty when entering to the Union. Setting up the theoretical background to the notion of sovereignty, this piece of written work assess the decision making mechanism within the European Union to determine who is the main sovereign, institutions or Member States. In many ways, the European Union challenges classical definitions of state sovereignty. There are no absolute answers to a question of whether the European Union is a state itself, or simply a supranational entity. Decision making procedures within the Union tell us that the European Union has some characteristics of a state, means of conducting foreign affairs, defence and security policies show supranational character of the European Union.

It is important to set the limits of the medium which I will present this piece of written work in order not to miss any important points and present my arguments clearly and effectively with respect to given word limit. Since the sovereignty at the European Union level is a vast topic and has many aspects, I will only focus on two points. First, to discuss is how law making procedures in the European Union have effect on Member State`s domestic sovereignty. This phase could be viewed as discussion of internal sovereignty. Secondly, discussion of external sovereignty of Member States to Union will be presented with case study of Common Foreign and Security Policy in detail.
