Özel öğretim kurumu öğretmenlerinin iş sözleşmesinin hukuki niteliği Yargıtay'ın farklı yönde kararlarına konu olmuştur. Sözleşmenin belirli süreli veya arka arkaya yapılan iş sözleşmelerinin belirsiz süreli iş sözleşmesine dönüşmesi öğretmenin iş güvencesinden yararlanması veya kıdem tazminatına hak kazanması açısından önemlidir. 5580 sayılı Özel Öğretim Kurumları Kanunu hükümlerine göre, bir özel öğretim kurumu ile öğretmeni arasında yapılacak olan iş sözleşmesi belirli süreli iş sözleşmesidir. Sözleşmenin süresini tarafları bir yıldan az olmamak kaydıyla belirleme yetkisine sahiptirler. Ardı ardına yenilenen belirli süreli iş sözleşmesi belirsiz süreli iş sözleşmesine dönüşmez. Zira sözleşmenin her yenilenmesinde Kanundan kaynaklanan objektif bir neden bulunmaktadır.

The Supreme Court has given decisions in the different directions about legal nature of the employment contract of private educational institutions teachers. It is important to terms of entitlement to severance pay or benefit from the job security to be fixed-term employment contract or turned into an indefinite-term employment contract for employment contracts made back to back. According to the Private Education Institutions Code (No.5580), employment contract which will be held between the teacher and a special education institution is a fixed-term employment contracts. Interested party have authority to determine to duration of contract not less than one year. Fixed-term employment contract which renewed in succession does not turn into an indefinite-term employment contract. Because there is an objective reason stemming from the code at every renewal of the contract.
