The article aims to briefly discuss the purpose and the extent of privileges and immunities enjoyed by international organizations. The main focus is on the North Atlantic Treaty Organization. The article argues that NATO needs its privileges and immunities to function effectively.

Bu metin uluslararası kuruluşlara sağlanan dokunulmazlık ve imtiyazların amacını ve kapsamını kısaca tartışmayı amaçlamaktadır. Metinin ana odağı Kuzey Atlantik Antlaşması Örgütü’dür. Metin, NATO’nun etkili bir şekilde işleyebilmesi için dokunulmazlıklara ve imtiyazlara ihtiyacı olduğunu savunmaktadır.

Introduction

The purpose of this article is to define the privileges and immunities of International Organizations, particularly the North Atlantic Treaty Organization (hereinafter: NATO or the Organization).

The conclusion of herein paper is that the privileges and immunities are essential for NATO to execute its functions and purposes effectively. The privileges and immunities will broaden and change as the needs of NATO changes to perform its mission.

The employed methodology is the following; (I) laying down the nature and legal background of privileges and immunities of International Organizations; (II) shortly touching upon legal documents of NATO that are relevant to privileges and immunities; (III) analyzing privileges and immunities in NATO legal instruments; (IV) conclusion of the paper.
